Introduction of the Law of the People's Republic of China on Import and Export Commodity Inspection

The Law of P.R.C on Import and Export Commodity Inspection(hereinafter referred to as the Law on Commodity Inspection) was adopted on February 21, 1989,  and was effective as of October 1, 2002 after amended on April 28, 2002. It contains 41 articles, which is enacted with a view to strengthening the inspection of import and export commodities, ensuring the quality of import and export commodities, and so on.

    It is provided in the Law on Commodity Inspection that the commodity inspection authorities and other inspection organizations set up by the State Administration for Commodity Inspection and the commodity inspection authorities shall, in accordance with the law, perform the inspection of import and export commodities. The principle of adjusting and publishing the list of commodities subject to inspection is embodied in Chapter Ⅰ. This law also states the conditions of exemption from inspection, requirements and procedures of inspection, and responsibilities of the commodity inspection authorities and staff members thereof.

    The Law on Commodity Inspection also provides the procedures of inspection concerning import and export commodities, the supervision and administration of commodity inspection, and legal responsibility. In Chapter Ⅵ, the Law on Commodity Inspection provides fees shall be collected by the commodity inspection authorities and other inspection organizations according to relevant provisions of the state for carrying out inspection or performing superintending and surveying services.
